These Terms of Service govern your use of services provided by Cloverhill Utica Tree Service. By engaging our services, you agree to these terms in full. Please read them carefully before scheduling any work with us.
Service Agreements
All tree service work is performed based on written estimates provided to you before work begins. These estimates are valid for 30 days from the date of issue. The estimate outlines the scope of work, pricing, and any specific terms related to your project. Once you accept the estimate, it becomes a binding agreement between you and Cloverhill Utica Tree Service. We reserve the right to adjust pricing if conditions on site differ significantly from what was observed during the initial assessment.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in writing. We accept cash, checks, and major credit cards. For larger projects, we may require a deposit before beginning work. This deposit will be specified in your written estimate. If payment is not received within 30 days of service completion, we reserve the right to charge interest at the rate of 1.5% per month on the outstanding balance. We also reserve the right to pursue legal action to collect unpaid balances, and you will be responsible for all collection costs including attorney fees.
Scheduling and Cancellations
We will schedule your service at a mutually agreed upon time. Weather conditions and equipment availability may occasionally require us to reschedule. We will notify you as soon as possible if this becomes necessary. If you need to cancel or reschedule your appointment, please provide at least 24 hours notice. Cancellations with less than 24 hours notice may be subject to a cancellation fee to cover our scheduling and mobilization costs.
Property Access and Preparation
You are responsible for ensuring that our crew has clear access to the work area. This includes unlocking gates, moving vehicles, and restraining pets. Please remove any valuable or fragile items from the work area before we arrive. While we take great care to protect your property, we cannot be responsible for damage to items left in or near the work zone. You must also notify us of any underground utilities, irrigation systems, or other hidden obstacles that could affect our work.
Liability and Insurance
Cloverhill Utica Tree Service carries comprehensive general liability insurance and workers compensation coverage. We will provide proof of insurance upon request. While we take every precaution to prevent damage to your property, tree work involves inherent risks. We are responsible for damage directly caused by our negligence or improper work. However, we are not liable for pre-existing conditions, hidden defects in trees, or damage resulting from acts of nature. Our liability is limited to the amount paid for services rendered.
Permits and Regulations
You are responsible for obtaining any necessary permits or approvals required by local authorities before we begin work. We can advise you on whether permits are likely needed, but the ultimate responsibility for compliance with local regulations rests with you as the property owner. If work must be stopped due to lack of proper permits or violations of local codes, you will still be responsible for payment for any work completed up to that point.
Warranty and Guarantees
We guarantee that all work will be performed in a professional manner according to industry standards. If you are not satisfied with our work, you must notify us within 7 days of service completion so we can address your concerns. We do not guarantee the health or survival of trees after pruning or other treatments, as many factors beyond our control can affect tree health. We are not responsible for subsequent storm damage, disease, or pest infestation unless directly caused by improper work on our part.
Emergency Services
Emergency tree services are provided on a priority basis and may be subject to premium pricing due to the urgent nature of the work and potential after-hours scheduling. Emergency service calls are assessed on site, and you will receive a price quote before work begins. Emergency services must be paid in full immediately upon completion of work.
Dispute Resolution
If a dispute arises regarding our services, we encourage you to contact us directly so we can work toward a resolution. We value your satisfaction and will make reasonable efforts to address your concerns. If we cannot reach an agreement, any legal disputes will be resolved according to the laws of the State of New York in the county where the work was performed.
Changes to Terms
We reserve the right to update these Terms of Service at any time. Any changes will be posted on our website with an updated effective date. Your continued use of our services after changes are posted constitutes your acceptance of the revised terms.
